Good morning. Please have a seat. All right, we are reconvening case number 26 CR88, uh, state of Ohio versus Caleb C. Flynn. Sir, are you Caleb Flynn? >> Yes, sir. >> All right. This begins our third day of trial. Um before I bring in um the jury council, are there any pre-trial matters we need to discuss? >> Uh no, thank you, judge. >> Okay. Um the court wants to address both the public spectators and the media before I bring in the jurors.
Um Friday we had a brief interruption before the court went off the record and um the court was trying to present to the jurors an admonition that's very important in in this process to maintain the integrity. So I'm forewarning you all um be allow the court to officially go off the record. the court will state that before you get out of your seats or stand or start talking so that we have a seamless um testimony and an accurate record.
Um we just want to make sure that everything um goes smoothly and that it's not uh interrupting to any degree um what we're doing here. So with that I will have the baiff bring in our jury. Please make sure your phones are turned off as well. Completely off. Thank you. Heat. Ladies and gentlemen, Joy, please have a seat. allow you a minute to get comfortable. Open your notepads if you deem necessary. Well, we are starting our day three uh the jury trial in state of Ohio versus Caleb C.
Flynn. [snorts] Um I will caution you to turn off your phones if you have them on you completely off. We are going to begin or continue with the state's case and chief. Um at this time u Mr. Watkins are you ready to proceed? >> Yes your honor state call senior specialist David. Mr. your hammer, if you'd like to come up to the witness stand. Once you get comfortable, if you'd raise your right hand, Miss Oendorf, our bail, will swear you in.
Please swear on the testimony you're about to speak to this court. This jury will be the truth, the whole truth, and nothing but the truth about >> Mr. if you'd like to inquire with this witness. >> Thank you, honor. Sir, could you please state your name for the record? >> Uh, David Hammond, H A M O N D. >> And what do you do for a living room, sir? >> Uh, I'm a special agent with the Ohio Bureau of Criminal Investigation. >> What's your educational background? >> Um, I have an associates degree from Road State College in law enforcement, a bachelor's degree from Tiffen University and Criminal Justice. >> How long have you been employed with the Ohio Bureau of Criminal Investigation? uh 18 years now. >> What's your current position with BCI? >> Uh I'm an investigator, a special agent with the force investigation unit. >> What does that involve? >> Um we uh assist uh law enforcement agencies around the state of Ohio with um officer involved shooting or use of force investigations. >> What was your position with DCI on February 16th, 2026? >> Uh I was a special agent in the crime scene unit. >> And what does that entail?
Um the crime scene unit travels across Ohio. Uh we help uh law enforcement agencies with uh crime scene investigations, uh the collection of evidence, um submission of evidence to the laboratory. >> And how long have you done that with PCI? >> Um I did that for about 17 and 12 years. >> What did you do in law enforcement before that? >> Uh I worked for the Lo Police Department. >> What did you do for the PD? >> Uh I was a cadet with them for about a year and a half.
I worked the road for about six and a half years. Uh and then I did crime scene work for them as well for about seven years. >> Can you briefly describe your training and experience in crime scene investigation? >> Um BCI does a wonderful job in training their agents uh with a a vast array of um topics from shooting reconstruction uh to blood spatter pattern examination uh photography uh labor print development. Um they're really wonderful about training us very well. >> Approximately how many felonies have you investigated in your career? >> Um more than a thousand. >> Approximately how many suicides and question death scenes have you investigated during your career? >> Maybe another two or 300 maybe 400. >> How many burglary scenes have you investigated during your career? >> Hundreds.
On February 16th, 2026, how were you assigned to assist the Titan Police Department in a homicide investigation? Uh, >> I was contacted about 5:00 in the morning from the agent who was taking the call uh for the weekend. Um, and he advised that Tip City was in they were investigating a death. Um, and he asked me to respond to the area to assist him. Approximately what time did you receive the call? Uh, about 5:00 a.m.
And approximately what time did you arrive at? at 9:32 Cunningham Court in Tip City, Miami County, Ohio. >> Uh 709. >> Who was present at the scene when you arrived? Uh Detective uh Bernard and Sergeant Grant. Who else was part of your crime scene examination team? >> Uh CST or crime scene technician Holly Resnik was there with me. She arrived a little bit later uh in the morning. Um and then uh Sergeant um Mike Morgan was also in and out of the scene assisting. >> What was uh CST Rise's role in the investigation? >> Um she worked alongside of me um collecting evidence uh doing the scene examination with me. >> Who was in charge of the scene while you were there?
Um, I was the most senior agent, so I take responsibility for the scene, um, and the actions and the the evidence that was collected. >> What information were you provided about the incident when you first arrived? >> Um, I was given an initial briefing. Uh, when I arrived, we were waiting on a search warrant. Um, and the information that I had was um, that the resident of the home is what information was given by overruled. >> Go ahead.
Okay. Answer the question. >> Thank you, ma'am. Um I I was told that um the resident uh out of the home called uh 911 about 2:30 in the morning. Um and that officers had responded to the scene. Uh the female resident uh Ashley Flynn was found uh in her bed uh deceased. Um the preliminary information that we had was that uh the male resident Caleb Flynn um was sick and that his wife had asked him uh to sleep on the couch because he was coughing.
I could only assume that maybe he was keeping people awake um and that at some point around 2:30 um that he heard a noise and went to check on uh the daughters uh in the bedroom close to the couch. And at that point, there was an intruder um that came in through the garage, uh made entry into the house, um and then shot and killed Ashley Flynn. What'd you learn about a weapon during the briefing? >> Um I was told that uh Mr.
Flynn kept a handgun, a loaded handgun in his Ford F-150 truck that was parked inside the garage. >> When did the scene examination formally begin? Uh, it began about 8:13 in the morning after the search warrant was resigned. >> What were the weather conditions at the time of your examination? Um, mid30s, overcast, some fog. Who do you look at as a suspect in a scenario such as this? Um, we consider everyone. Um, we investigate a great deal of homicides.
Um, often times we'll get um a set of information um and it's it's kind of a a starting point for us, but every time that we we go into a situation like this, we have to consider um a family member or a person who's present um if someone passes away or dies as a result of a violent crime. The people present are always suspects. Um but we don't always we don't just look at them. We have to examine the scene as if uh someone came in from the outside uh broke in and then harmed the victim. >> You may. >> Thank you. >> Special agent.
I'm now showing you what's been previously archived education purposes as states exhibits 8 through 28. Could you please look at those for me? What do those exhibits represent? >> Uh, these are photographs of the exterior of the home at 932 Cunningham Court. They're photographs that I took and they fairly inaccurately depict the house on the day of the examination. Commission publisher, >> you may special, can you describe general layout of 932 Cunningham Court?
Um the home is a ranch style house. It's a one story. Um the the home faces the west and it's situated on the east side of the home or the east side of the roadway. The house has like a brick front. Um and t like tan vinyl siding. Uh there was a patio on the east side of the home. Um what can you tell us about any garage? Uh there was a threec car uh attached garage on the north side of the hall. The doors face the the west.
We published here states exhibit 8. You recognize that? >> Yes, sir. What does this show? >> Uh this is a photograph of a mailbox just with the house numbers and states exhibit 9. Uh this is a photograph of the front of the home. Uh, this is a photograph of the um I believe this is a photograph. Would help if we showed you the photo itself rather than publish on. Yeah, a little glare there. This is a a photograph what you see um this is a photograph looking to the south.
You only see a small portion of 932 Cunningham itself. It's along the left edge of the photograph. It just kind of shows the front yard of 932 Cunningham 671. This is another photograph of the front of the home just showing the porch, the front porch area. Stacy's 12. Uh, this is a closeup of the front porch. Stacy Z 13. Uh, a photograph of the front door. What' you observe about the front door when you examined it? >> Um, when I arrived, the the front door was uh slightly a jar.
Uh it was open and there was some indication that the officers um had made entry into the home through that front door. Uh there were no signs of forced entry that I noted um to the door to the screen door to the door frame. What locking mechanisms did the front door have? >> Uh it had a handle locking mechanism as well as a deadbolt. Would you observe regarding the windows of the home? Um, we examined or I examined um each of the windows along the front of the home.
All of the windows were shut and locked. Uh, a lot of the windows had like screens in place. Um, we also checked I also checked the rear windows. Um, those windows were also locked and shut. Uh, many of those windows had screens in place. Uh, there was a a window into what I call the children's bathroom. It's the bathroom between uh the children's bedroom and the playroom. Uh this is in the south wall of the home. Um it was shut, but it was unlocked.
Um what did you notice in regards to any disturbances to the shrubbery or mulch around there? >> There was no indication that anyone had opened that window and climbed in. Uh there was no um scuff marks or mulch or dirt on the side of the wall. State exhibit to 14. Is that a photo? This is a photograph. It's just a closeup of the locking mechanism of the screen door here at the front door of the home in space. Exhibit 15.
This is a photograph of the garage doors. Uh this is going to be on the west wall of the home. Stage exhibit 16. Uh this is a photograph looking north. Um, this is not a photograph of 932. It just shows the yard area north of the home style 17. Uh, this is a photograph taken about from the same vantage point. It's looking to the east and you see the um kind of the north wall of 932 uh Cunningham. Um, you see a door and a [clears throat] trash can.
Exhibit 18. Uh this is a photograph of the north wall. It's just taken from a vantage point looking to the south and it depicts the the door leading into the garage and that north wall as well as the blue republic trash can exhibit 19. Uh this is a photograph just looking back towards the street or to the west taken from that same north wall area 620. Uh this is another photograph just looking into the backyard. It's taken from the area of the north wall space exhibit 21.
Uh this is a close-up photograph of the north wall garage door and the blue trash can. This is how you found this area of the home when you arrived on scene. >> It is, sir, states. Exhibit 22. >> Uh, this is a photograph of the north wall of the home. It's just kind of a kind of where the wall kind of uh bends around showing the air conditioning unit, the condition of the window there. Stace exhibit 23. Uh this is a photograph of the back wall or the east wall of the home.
Um it just shows the patio area, the hot tub, and um some lawn furniture. >> How did you examine the rear of the home? >> Um we went down uh I went down and checked each window, made sure that it was shut or locked. Um we looked I looked around the lawn furniture itself. Uh opened up the hot tub. Uh there was like a pillow inside of it. Checked inside of the pillow for any evidence. Um just walk the area for evidence. >> What type of door is located on the rear of the hall? >> Uh there's a full glass metal entry door um that opens into the home from the patio into the the living room area.
And what locking mechanisms does the rear door have? Uh there's a deadbolt lock that was locked at the time of examination. And then there's a handle locking mechanism. It was unlocked at the time of examination. >> What signs of force entry did you observe on the rear door? >> No. Safety 24. >> Uh this is a photograph of the south wall of the home. Um I previously mentioned a window that opened into a child's bathroom. um that was unlocked but it was closed.
Um and that's that window that I was speaking about. See, exhibit 25. Uh this is a close-up photograph of the front door of the home. What type of door is it? >> Uh steel door says exhibit 26. This is a photograph of the door frame just depicting the receivers for the handle and for the deadbolt just showing the condition uh of the door frame. Anything there suspicious? >> No states exhibit 27. Uh this is a photograph from inside the home.
It shows the interior side of the um door opening out onto the patio at the rear of the home. again states exhibit 29. Sorry. >> This is just a photograph that just shows it's a closeup photograph showing that the deadbolt lock is engaged. >> What was identified here is the entry point of the home by intrigued and within the the door in the north wall of the garage. Mhm. Thank you. Special game. I'm now handing you what's been previously marked for identification purposes.
This exhibits 29 through 39. Could you look at those please and tell me what they represent? Uh these are photographs that I took of the door um and the door frame of the of the garage door per and they fairly inaccurately depict the scene as you observed it on February 16th, 2026. They do permission to publish. >> You may What did you first notice about this door? Um, the first thing that I noticed uh was that um the handle locking mechanism or the handle on the outside of the door have been broken off. um the handle and like the collar um which is like the technical term is like a rose, but it's a it's kind of like an accent piece.
It goes it's on the inside of the handle itself. Um both of those uh pieces were were broken off of the door handle themselves and they were lying on the floor inside the garage floor. 30, please. Stace exhibit 30. What are we looking at here? >> Uh, this is um a receiver for um a deadbolt. Um it was found on the concrete just outside of the garage door itself. It's between the north wall and the blue Republic trash can.
Um and you can see that it's damaged. Um it looks like it's um it's been bent. Where is a receiver typically installed? Um, so as the door swings shut and you lock your deadbolt, the throw or that little uh the little rod comes out, the receiver is inside of the door frame itself and then the throw will go inside of that receiver uh creating that that uh that lock securing the door. 31, please. What are we looking at here? >> Um, in this [clears throat] particular photograph, you see um, uh, you see the receiver between the north wall and the blue trash can.
And then on the inside of the door, um, you see the broken off door handle and then that collar or the rose. >> Would it help if you step down and were able to point at the photo? >> Yes. not permission for him to approach. >> The witness may step down and indicate on the unknown. >> So this is won't show it won't show on the TV. >> Um so this is um >> Could you come could you come over here where the actual photos are?
Sure. Sure. So this is the receiver right in this area. And then this is the brokenoff handle and the rose with the collar. There were also um two screws right in front of the door on the concrete inside or outside of the garage outside. You can stay there for a minute. Stakes exhibit 32. Please what is this? This is a closeup of that same area. Again, the collar and the broken off door handle. Stace exhibit 33. This is a photograph of the door frame.
Um, and it just shows the condition of the receivers uh and the the frame itself. States exhibit 34. [clears throat] This is a closeup of that same area. And let's see it out to you in this photo. Uh the one thing that was uh fairly unusual was that in this area right here, this soft wood of the door frame, um I I didn't notice any marks. Why is that important? Um, if you're going to force a door open, um, typically what you do is you take a pry tool and you insert it between the door and the frame.
And the idea is to create leverage to pull the locking mechanisms, the throw and the latch out of the frame to force it inward. So typically what we see like in a burglary is we see those receivers displaced from the valve and then we see um a tool mark impression in this area and often times we see like a paint shelf states exhibit 35. This is a photograph from inside of the garage uh looking at the board itself. Stay exhibit 36.
Uh this is a photograph. It just depicts uh the angle of the door and its position against the refrigerator that was inside of the garage. What locking mechanisms does that north garage side door have? >> Um it has a a handle locking mechanism as well as a dead bolt. And approximately what angle here is the north garage door open when you arrive? >> Approximately about 45°. And where was the refrigerator positioned in relation to the door? >> Uh right against the door exhibit 38 >> 37 37.
Thank you. This is a photograph. It's a closeup of the edge of the the door, the same we've been talking about, and it just shows the condition of the dead the dead bolt itself, the throw, and then the latch bolt of the handle and what's coming out to you there. Um, again, um, I couldn't find any damage with that latch bolt. I couldn't find any damage with the dead bolt itself. Um, both of those locks were unlocked when I examined them.
Um, that was really curious. There was no evidence that I could see where a pry tool had been inserted in between the door and the door frame to force it open. And when you examined them, were you locking and unlocking those mechanisms and were how did they function? And when you observed them in the locked position or where the bolt is out, what did you observe? I didn't observe any damage to those. States exhibit 38.
Again, this is another photograph. It's just from a different angle showing the interior side of the door. Uh the deadbolt uh the locking the handle locking mechanism and the condition was founded in states exhibit 31. This is a photograph just from inside of the garage looking out of that garage door. Um, you can see the the collar of the rose as well as the handle that was broken off. Thank you. You can have a seat for me.
How did the How did the condition of this door compare with the hundreds of burglaries you worked previously? Um, it it didn't look right to me. Um why um the damage uh was just inconsistent with any of the other burglaries that I've worked on as a crime scene investigator. Um the typical burglary you see damage to that latch bolt of the handle. Typically it's pushed outward um because the door is being forced open and pushed through that frame.
Um, typically we see the deadbolt throw being pushed towards the outside, the doors being pushed inward. Um, the um the damage on the inside of the frame uh around that locking that deadbolt lock receiver, there was pieces of wood that was chipped away. Um, but there was no corresponding damage um on the frame. There was no corresponding damage on the door itself. Um, as I stood there inside of the garage, it looked to me like the damage had happened with the door open. >> Could you show the 31 windows?
You mentioned some wood chips. Do you see the wood chips in this photo? >> I do. Um, they are right between the door handle that's broken off and the collar. They look like brown little slivers of wood. Um, they're linear and thin. It's basically the 32. You see the widgets in that photo? >> I do, sir. Um, it's going to be um May I judge? May you step down here? Thank you. These are the the wood chips that we notice.
What' you notice about the exterior surface of the north garage door? >> Um, there was no um evidence or there was nothing that we could see or that I could see to indicate that the door had been um kicked open or forced open. At some point in combination of the crime scene, we enhance the outside of that door with fingerprint powder. Um sometimes um we can visualize like a shoe print or a tool mark uh with that fingerprint powder and by examining that exterior of that door, there was nothing that I could see to indicate that force had been applied to the outside of that door.
What had happened to the exterior doorork knob in rose or that metal collar you talked about the trimies? Oh, we collected those as evidence. And when you did, what did you believe happened to them? Um, there was there was a kind of like a indention on the door handle itself. Um it looked like it had been impacted um possibly by something with like a a circular shape just by the indention uh and the knob itself. >> What is the cylinder on the door? >> Uh the cylinder is the the mechanism or the portion of the handle locking mechanism and it kind of lives inside of the door between the two handles. >> Was the cylinder intact on the exterior side? >> It was.
Was it firmly mounted? It was How did you examine the door frame and weather stripping around the locking mechanism? Um we um photographed it. Um we actually like closed the door um and took additional photographs um just to make sure that there wasn't anything to indicate that a tool had been placed through that weather stripping and and used to pry open that door. >> And what did you observe when the door was shut?
Aside from the handle lock of the handle being broken off, I couldn't find anything to indicate that that door had been forced open. You mentioned there was a strike plate on the ground between the trash can and the north wall just outside of that door just west of it. Correct. Correct. Um, did you observe a second strike plate for that deadbolt? >> There was there was one inside of the frame, the door frame itself. Um, it was slightly recessed or probably like a little deeper into the wood of the frame.
And um, it almost looked like uh that first deadbolt receiver where the throw would go in had been cut like too deep. Um, and it they needed a second deadbolt receiver to be put in on top of it. Um, the deadbolt receiver that was mounted in the door frame had kind of these offset screws. Um, typically the screws are mounted in the center and someone had taken the time to drill new holes and and to mount that inner receiver um offset so that would allow um someone could mount a second receiver to kind of be flush with the edge of that wood through the center holes.
Stace exhibit 34. Is that that second strike plate you're talking about with the holes drilled and offset screws? >> Yes, sir. Sure. not been previously barrierification purposes states exhibit 250. Do you recognize that? >> Yes, sir. >> How do you recognize it? >> Uh this is evidence item number 20. It's the door strike plate uh found uh near the garbage can outside of the garage. Uh this was collected by me on uh February 16th, 2026 at 9:32 Cunningham. >> And what can you tell us about the condition of the packaging now as compared to when you packaged it?
It looks like it's been opened um a couple times and likely examined like in a laboratory setting. >> And are all those seals still intact? >> They are. And could you open that door, please? >> Yes, sir. And what's inside? >> Uh, there's a second bag, brown paper bag. It's marks 2026-0293-1 or 1 packaging B12. This is something that I'm not familiar with. >> Are all the seals intact? >> They are. >> Okay. Could you open that, please?
Heat up here. And what are you holding there in your hands? Uh, >> this is the um strike plate that we recovered on the concrete outside of that garage door on the north wall at 932 Cunningham as well as the two screws that were found just outside of the garage door on the concrete path. >> And are those in the same condition as when you packaged them? >> Yes. >> How bad is that bend? You know, what can you tell us about the bend in that strike plate?
Um it's it's it's it's uh fairly bad. Um it looks like um something has um been used against this to to bend it pretty well. And >> how is that been consistent with forced entry if it were installed on the door frame? So, um, with this particular strike plate, um, one thing that you'll notice is that there's beveing, um, on this side of the strike plate. Um, typically, if this is installed correctly, um, what happens is is that the screw is placed uh, into this hole on this side.
Um, and the screws themselves have a little bit of a bevel and allows the door to swing. um easily and it doesn't get caught up on the strike plate itself. Typically at normal burglaries what we see is we see that this edge of the strike plate if this is installed correctly this will be pulled out. Um how is this one pulled? Uh this one is pushed in. What are the conditions of the of those two screws? >> Uh the screws themselves are um they're not bent.
I don't note any uh wood fragments from being pried out of the door. What does that tell you? Um typically what we see with these types of screws and this receiver is that the the screws are forcibly pulled out of the wood. um they're bent badly most of the time and a lot of times they take um pieces of wood with them. Um and we did not see that at the scene and I don't see that here. >> What evidence number did you assign to the plug and screws at the scene? >> 20.
Everything's back in the package there. >> Yes, sir. >> Now, you must marked for identification purposes. This case exit 2501. You recognize that? >> Yes, sir. >> What do you recognize it to be? Uh this is the door handle uh that was located near the exterior garage door out outside of uh this is the door handle at that garage door. And uh what's the condition is that the packaging you placed there when you collected it? >> Yes. >> And what's the condition of the packaging now as compared to when you collected it? >> Uh it's been opened a couple times probably in a laboratory study. >> And are those seals intact? >> They are.
Please open that for us. >> And what are you now holding? Uh, a brown paper bag. It's labeled as 2026-0293 uh 1, packaging B11. You recognize that packaging? >> I don't. Are the seals intact on that packaging? They are. Please open that packaging. >> Do you recognize those two items? I do. What do you recognize them to be? >> Uh these are um this is the broken door handle and the collar or the rose that was found uh at the garage door uh in the north wall of the garage. usually have been found just inside of the pool. >> And what stands out to you on those two pieces of evidence? >> Um, in particularly this impact mark, I think I described it earlier as like circular in shape.
Um, possibly from something impacting it. And then again, there's a some damage to the collar or the rose where it looks like something has impacted or created an indention. You know those that doornob and the rose are in the same condition they were in when you observed them on February 16th at 9:32. They are Everything back in the bag. Yes, sir. Thank you. >> Now, you must been previously marked for identification purposes is states exhibit 252.
You recognize that? >> Yes, sir. >> What do you recognize it to be? >> Uh, this is uh pieces of the wood from [clears throat] uh inside the garage door. Is that the same package you collected the items in? >> Yes, sir. >> All the seals um intact on that packaging? >> Yes, sir. >> How does it change now from when you collected it? >> Uh it just looks like it's been opened um due to lab testing. Could you open that first, please?
Could you describe those for us, please? These are the the wood fragments uh that we found uh inside the garage door in that north wall. Um, it appears like there are marks along with pieces of wood. >> Those are the same condition as when you observed them on scene. >> They are. >> What color paint is on those? >> Um, there's white. >> And how does that compare to the door frame? >> Uh, the door frame was also white. >> Based upon your investigation, where do you believe those wood pieces came from? >> From the area of the deadbolt receiver.
What item number was assigned to those work on 22? Okay. Which item what item number was assigned to the arrows? Uh 21. How did you decide where to collect the DNA in this case? Um, primarily, um, we worked off of the statement given by, uh, Caleb Flint. Um, you know, he described, uh, an intruder in that north wall of the garage, uh, moving through the garage into the home. Um, into the hallway of the home and then into the bedroom.
So, any place that there was a door handle. Um and then we we kind of we do some overkill collection which is like um um other door handles. Um they may not have been uh indicated in that preliminary statement but we we just try to collect as much as we can. sink sink handles. Um, any place that someone potentially could have touched? >> What potential DNA evidence did you collect from the north garage door area? >> Um, we collected a scanner from inside of the um the interior handle of that uh north door. >> What you use to collect that DNA of us?
Uh the DNA evidence is collected onto a sterile swab. It's uh moistened with with what we call stain extraction buffer or you'll hear us say SCB a lot. What other item near the north garage door was swapped for DNA. Um we swapped the interior handle and then we swabbed the um the front of the trash can. It was kind of a handle. Um, and my thought was that if someone had used a pry tool or they had broken into the door there that they may have touched or handled that trash can handle while they were manipulating the door. >> Did you search the contents of that trash can? >> I did. >> And what the trash can contain? >> There was a like a grill cover that was in pretty bad shape.
Uh, there was some yard debris and just little bits of trash. What items of evidentary value were found in the trash can? >> No. >> Which piece is all back there in the state except 252? >> Yes, sir. purposes exhibit 253. Do you recognize that? >> I do. >> What do you recognize it to be? Uh this is a um an Acutrans pass that we made of the tool marks and the door frame um just behind that deadbolt receiver in the north garage door. >> So in this you describe in this photo here that's up on the where that is.
Um yeah, it's just right behind um it's going to be just behind this receiver right in this area right here. Can you explain uh the process for making an ACT trans cast? It's um about the best way that I can describe it is as if you ever played with silly putty. Um silly putty is kind of a flexible material and you would uh press it into something and it makes the shape of whatever you press it into. Acutrans is a little bit like silly putty in that it's a um kind of a liquid material and then there's a hardening agent.
And so we place that into the tool mark itself. We let it dry and then we carefully remove that and it gives you a picture of uh the shape of that tool mark. What did you observe that caused you to make a cast here? Um there were marks uh there were small cuts in the wood. Um and they seemed to kind of repeat through there. Um it was uh if someone had broken into this door, it was um it was the best representation of the tool that would have been used.
Could you open safe exhibit? Well, first off, you recognize the packaging. Is that the same package you place that cast into? >> It is. Um and how has that package changed from when you packaged it? It just looks like it's been open for laboratory testing. >> And are the seals that have been added to it still intact? >> Yeah. >> Would you open it for us, please? And what do you recognize that to be? >> Uh, this is the Acutrans cast of the tool mark uh there at that garage door right behind the deadbolt receiver. >> And how does it condition now compare to when you created the cast?
It >> It's about the same. What uh what material did you use to enhance to back in the back? Thank you. What material did you use to enhance the exterior of that north garage door? Uh sterile fingerprint powder. >> What is that? >> Uh we use um a sterile method to examine things at crime scenes. That means that we never dip um a fingerprint brush into the canister of fingerprint powder. Um typically the method is to dump a small amount into a brown paper bag.
Um and then we use sterile brushes um and then uh the fingerprint powder is just applied to the surface that we're looking for either tool marks um shoe wear impressions or laten prints. >> What were you looking for when you enhanced that air surface? all of those. I was looking for if I could enhance any tool marks, um if there were any shoe wear impressions, um any latent prints. >> And what did you observe after you applied the powder? >> I I didn't locate any um shoeware impressions um or transfers.
I didn't locate any tool marks. >> So, what damage did you locate on the exterior door surface? >> Aside from the door handle being broken off, none. person. You may Thank you, >> sir. I'm not showing you what's been previously marked for identification purposes the states exhibit 61. Do you recognize that? >> I do. >> What do you recognize it to be? >> Uh, this is a diagram of the crime scene. >> And how was that created? >> Uh, we have a a 360 degree digital scanner that we employ at crime scenes.
Um, in this instance, uh, crime scene tech Holly Resnik, uh, operated that for me. Um, the the scanner is moved throughout the house and a number of points are or are recorded and that, um, recording that digital recording is used to create a a model of the house. I realize it's not perfectly to scale, but does it fairly and accurately depict kind of a bird's eye view of the residence and some of the contents of the residence? >> It does.

Could you please describe that? >> Uh, this is a photograph of the garage. Um, it's the south wall of the garage looking towards the east. Um, and we're kind of looking at the edge of a Ford F-150 pickup truck.
And we're looking at the door that leads into the hallway to the living space of the home. Where was the truck parked in the garage? It would have been on the south side of the garage. Is that the double double door side? >> It is, sir. >> The van was on the single door. >> Yes, sir. >> 41. >> You recognize this photo? Yes, sir. What does it show? This uh is a photograph taken from that door leading from the garage into the interior of their house.
It's just from the opposite angle. It's looking out into the garage. It just shows like some bicycles and a collection of shoes on the ground. Stacy's the 42. >> What does this show? >> Uh this is a photograph of the Ford F-150 that was parked on the south side of the garage. It's taken from that north wall looking south exhibit 43. Uh this is a photograph of the middle of the garage. You'll see uh another blue republic trash can close to the garage doors.
Uh a power wheel. Um a snow thrower and a wheelbarrow. Stacy's 44. >> Uh, this is another photograph of the Ford F-150 truck. >> And what information we provided in your briefing about that Ford truck? Um, the detectives had stated that um, you know, as they talked uh to Mr. when he had indicated that there was a um a handgun in the armrest console of the truck. Um and the officers indicated that that armrest was in a vertical or open position. >> And what position was the armrest console in when you came vertical? >> I'm sorry.
Open and vertical. states exhibit 45. What do we see here? Uh this is a photograph taken along the east wall of the garage and it's um from the the doorway leading into the house and it's pointed towards that refrigerator that's along the north wall and you see the front of both of those vehicles and there was a like a foam mattress um or like a cube foam cube along that east wall. Uh, this is a photograph of the Chrysler Town and Country minivan.
Um, parked on the north side of the garage. >> How would you describe the cleanliness of that? >> Uh, it was clean. 607. Uh, this is a photograph of that same van just taken from a slightly different angle. into 48. >> Uh a photograph of the north side uh just depicting what was on that north side of that van on the floor. So where's the north door in this picture? >> Uh just behind it. Did you examine the refrigerator? >> I did. What' you find in the freezer? >> Uh, there were packages of black frozen meat. >> How about in the refrigerator portion? >> Uh, there was some baking soda, but it was um there was very little else in inside. >> Stacey said 50. Uh, this is a photograph of the inside of the freezer. >> What's on top? >> Uh, it looks like there's a um a floor mat. um kind of one of those like weather tech plastic formats and um a box.
Say this exhibit 51. Uh this is a photograph of the interior of the refrigerator 52. Uh this is a photograph of like a like a tool bench or a workbench area. This would have been along the east wall inside of the garage. Um, there was also like a small scooter or motorcycle kind of look like a best boat parked in that area. States exhibit 53. Uh this is a photograph of the um Chrysler minivan. Uh this photograph was taken from outside of the garage door with the garage door open. Space exhibit 55. Um a photograph of the uh vehicle's license plate. Space exhibit 56. Uh this is a interior photograph um looking in the driver's door of the Ford F-150. And you'll kind of note that um on that right hand side, the armrest is in that vertical uh or open position. >> Did you examine that armrest console? >> I did. >> What specifically were you looking for? >> Uh the firearm that was supposedly stored there.
How successful were you in finding the firearm or any ammunition? >> Uh there was none inside of that armor states exhibit 57. >> Uh this is a closeup of that same uh armrest area showing that the armrest is in the open position. Sty 58. This is a photograph looking down into the armrest storage area. There was a kind of a tray that was um on top um with some air fresheners. And then you can see uh the bottom of the uh storage area as well. >> Exhibit 59. >> Uh this is a door that leads into a mechanical room.
Um, just to the south of the workbench, there was a uh small room that housed the furnace, the water heater, um, and some storage. Stacy, exhibit 60. Uh, this is a photograph inside of that mechanical room. Back to the truck. How did you search it for evidence? >> Um, uh, we photographed the the vehicle itself. Um, systematically we worked through the vehicle. Uh, we looked under the seats, uh, in the passenger compartment.
Uh, we elevated the seats in the back seat and live underneath them. Um, checked the the bed of the truck. Um, we swabbed the uh, driver's door handle uh, for um, DNA. We swabbed the latch um, of the armrest for DNA. Um, we just look for anything that could indicate um, possible make and model of the weapon, any ammunition, um, any evidence that would have been left behind from someone going inside that vehicle? >> What items of evidentary value that did your search of the truck produce? >> Um, aside from the DNA, um, and the latent prints, um, nothing. >> What other [snorts] areas in the garage did you obtain them?
Um, we looked inside of the trash can inside of the garage. Um, I did a cursory examination of the workbench. Um, I did a cursory examination of the um the mechanical room, but those were areas that I asked uh the tip city um uh police detectives to look more thoroughly in. >> Were they in the home while you were doing the search >> at times? Yes. How would you describe the condition of the workbench area? >> Um it was um it it looked like a workbench where people were working.
Uh there were a lot of tools scattered around and um it was uh disorganized. Um there were there was a volume of things there. You may sir, I'm now showing you what previously identification purpose states exhibit 6265. Take a look at those for me, please. Sir, >> you recognize those? >> Yes, sir. >> What do you recognize them to be? >> Um, those are photographs of the hallway uh leading from the garage into the hall.
And do those fairly and accurately depict the scene as you observed it? They do. Um and on the left side of the picture, you're seeing just a little glimpse into the kitchen area and states exhibit 63. Uh this is a photograph of the door leading out to the garage.
It's taken from the interior side and it just shows the condition of the deadbolt lock and the handle locking mechanism. >> How would you describe the condition of those two locking mechanisms? >> Um I couldn't detect any signs of any forced entry on either lock. They were in good condition. State exhibit 64. Uh this is a photograph from the garage looking into that hallway. It's the same door. On the left hand side, you're seeing a little glimpse inside of a laundry room.
At the end of the hallway, you're getting a glimpse into the master bedroom and safety 65. Uh this is a photograph just of the the floor in front of that doorway into the hallway. Where's the primary bedroom located in the home? >> Uh, it's on the north side of the of the residence. Um, and along the east wall. >> What rooms are attached to the primary bedroom? >> Uh, there's a walk-in closet as well as like a a bathroom. >> What size bed was in the primary bedroom? >> Uh, it looked to be a king size.
Where was it positioned? uh along that east wall. >> How many nightstands were in the bedroom? >> Uh two. >> Where were they positioned? >> Uh on the north side and the south side of the bed. How many dressers are in the primary bedroom? >> Um I believe two as well. Uh one along the north wall and one along the west wall. Was there a television in the room? >> Yes, sir. >> Where was it located? >> Uh the west wall. >> Where did you observe a fan in the primary bedroom? >> On the south wall, sir.
Could you describe the fan, please? >> Um, it was a like a typical box fan um resting along the wall. Um, it was very close to the wall. Um, and it was at u I think the three setting or the highest setting. Um, what do you see here in states exhibit 66? >> Uh, this is an overall photograph of the bedroom. Uh, what's depicted is the uh the bed along that east wall. There's a white door in the north wall that opens into the bathroom area.
Um you see um a white um like a bedspread or a comforter. Um and you just see the very beginning of Ashley Cole laying on the bed. Takes exhibit 67. Uh this is a photograph looking to the east. Um you see uh the two nightstands on the north and south side of the bed. Um what's noted in this photograph is just the condition of the bed, the white gray comforter, um and the sheets. This exhibit 68. Uh this is a photograph.
Um it shows the overall positioning of Ashley Flynn. Um it just shows um a white towel uh that was behind her head. You'll see some uh reddish staining which was suspected blood. Um and her body is covered by that white comforter. State exhibit 69. Uh this is an overall photograph of that master bedroom. Again, uh you'll notice that um in this photograph there are some yellow placards that have been inserted um just kind of marking out different pieces of evidence.
Um and it just shows the overall condition of the bedroom. Exhibit 70. Um, in this photograph, what you see is that we have moved the white comforter off of the bed. Uh, we've collected it, packaged it as evidence, and then it shows the position in which Ashley Flynn was found. Space exhibit 71. Um, this is a photograph uh showing Ashley Flynn. um her uh the overall positioning. Um she's laying on her left side. Uh her head is pointed towards the east, her feet are pointed to the west.
Um her right hand and arm is is tucked up close to her face. And her left arm is extended uh underneath a pillow. Um again, you see the white towel uh behind her body. space exhibit 72. Uh this is a photograph showing Ashley Flynn's uh positioning. Um you'll notice her left arm is underneath that gray pillow. Um you'll notice um that there's a large amount of blood that's been um has u saturated the pillow and the sheets below her.
Um you see her right arm or her hand tucked underneath her chin area just the overall condition um of her body. And when you observed Ashley in this position, how many gunshot wounds did you observe? >> Um, because of the the nature of the wound in the position, um, I wasn't able to tell, um, what type of a wound that was. Um, it was very obvious that there was a large volume of blood that was coming from that wound.
And there were there was also brain matter that had escaped that wound. But because of her hair and the volume of blood, I I couldn't tell you what made that room. Is it 73? Uh this is a photograph. Uh this is going to be uh the west wall of the bedroom. Um in this photograph, you'll notice that there's a couple placards. Uh placards one and two are down on the floor beside um some pillows. Um, and placard three is by a a laptop computer on the dresser. >> What are placards one and two markings? >> Uh, placards one and two are marking um two fired cartridge casings.
Uh, they had the head stamp of WCC 03. >> And what caliber were those casings? >> Um, the headstamp didn't indicate, but I've since learned that they [snorts] were 9mm cartridge casings. And you mentioned states, I'm sorry, placard 3. What's that market? A black Dell laptop. States exhibit 74. Uh, this is a close-up photograph. It just shows the stack of pillows in front of that dresser. There's one with a a gray pillowcase and then there's a a couple that look like they're more decorative.
Um you'll see placards one and two and those placards just indicate the positions or the locations of those 9 mm fire cartridge casings. Casing 75. Uh this is a closeup of that first cartridge casing. in states exhibit 76. Uh closeup of the second case. States exhibit 77. This is um a closeup of the headstamp. Uh this is um at the back side of the cartridge casing and just kind of shows us um uh who manufactured that particular projectile. states exhibit 78.
Uh a closeup of the headstamp of that second cartridge casing station exhibit 79. Uh this is a photograph of the nightstand on the north side of the bed. Um there are um a few placards in this photograph. Um, six being the towel. Um, four being an Apple iPhone. Uh, eight was used to mark um a water bottle that was opened. And five was a a brown leather purse uh on the north side of the nightstand. Stays exhibited 80.
Uh, this is a closeup of the Apple iPhone on the north side of the bed on the nightstand. States exhibit 81. Um, in this photograph, I've just turned the phone over and tapped it um to see if there was any information on the phone. States exhibit 82. Uh, this is a photograph, a closeup of the water bottle on that same nightstand. 83. Uh, this is a photograph inside of the nightstand. I've just pulled that drawer out and photographed the contents.
What's present in the front of that and what you see an airpod case in. >> I I apologize. I'm very sorry. Uh, I misspoke. Um, states exhibit 83 is a photograph of the nightstand on the south side of the bed. Um, this is not where we located the phone. This is on the south side. Um, and inside of this drawer, there were uh three boxes of 12 gauge ammunition. um a a smartwatch with a broken uh wristband and um like some Apple I earbuds uh a case for those.
Before we got into all the photos, we started talking about a fan. Um what was the condition of that fan when you arrived? Uh, it was running. And that's the fan on the south side of the uh bedroom wall. >> Yes. >> What speed was it set to? >> Uh, three or the highest. And how close was the fan to the wall? Um, within inches. As close as you could probably put it to the wall. How much air was moving from the fan? Um, very little.
Why does the fan appear to be off in crime scene photographs? Um the shutter speed of the camera is is fast enough that um it kind of captured that image as the blades were spinning and it looks like it's uh standing still but it was it was running. When you walked in and observed Ashley in the bed, which side was she in? It would have been the north side of the bed. What did you notice about the south side of the bed?
Um there was uh uh I don't I don't believe that there was a pillow on that side. Um there was no indication that someone had been there. >> What do you mean that someone had been in there? >> Um you know, normally when you when you sleep in a bed, you there's a couple pillows or a pillow or two. Um I didn't note that. When I walked in, it looked like she was sleeping by herself. Based upon your observations regarding Ashley's overall position, what can you tell us about her sleep condition at the time she was shot? >> Um, one of the things that we examined uh was uh the flow pattern uh of the the blood from her nose and mouth.
Um and um from how we examined her and and her overall positioning, it appeared to us was visually consistent that she was asleep or lying still in that position uh when she was harmed. Who did you contact regarding examination of the victim? Uh the county corner that Dr. William again. >> Yes. >> What permission did Dr. give you to do? >> Uh he gave us um permission to do like a cursory examination uh of Ashley Flynn.
Um we checked for rigor. Uh we checked for leidity. Um and then um we placed her into a new clean uh body bag so she could be transported from the scene. Could you describe Ashley's appearance when you began your examination? >> Um, you know, from the photographs, you know, she looks like she's um lying on her left hand side. Again, you know, her her right hand is tucked up underneath her chin. Her left arm is extended beneath that bolo.
Um, there was leidity that was present along the left side. Um, which is consistent with her overall positioning. Um there was um a secondary injury site on the uh left side of her head um close to the hairline. Um her um clothing was in good condition. Uh she was wearing um a black pajama top and black pajama pants and socks. Um those were in good condition. Uh there was no evidence that um like those had been displaced or damaged or there was there was no indication that there had been a struggle that had taken place.
What item had been placed at the back right side of her head? A white tan towel. And what you observed when you examined the area behind Ashley's right here, >> um there was um an open wound uh right in this area. Uh it was very difficult to say or to tell what had created that wound. Um again because of the volume of blood, because of the amount of hair and then there was um brain matter that had protruded out of the wound. >> You mentioned rigger.
What is rigger? Uh rigger happens after someone passes away there's a chemical um and the abbreviation is ATP and um about 2 hours after death uh your muscles begin to stiffen um it starts in the jawline and it moves out to the upper extremities and the lower extremities and over time u deceased people become very rigid. Um and when I examined uh Mrs. time she was in a a state of rigor. >> Approximately how much time had passed from the 911 call until you examined Ashley's body? >> Um I I was told that the 911 call happened about 2:30 in the morning.
Um because we don't rush right to the body. Um, I've always been taught that you examine um the entirety of the of the scene before you go and look um at a body. Um, it just helps you um take a better picture of the totality of the circumstances in the event. Um, it was probably 9:30 in the morning before we began to photograph and work with Mrs. Flynn. >> And did you observe there's a child before you made your way to the primary bedroom? >> I did.
You mentioned levidity. What is levidity? >> Uh levidity is like a staining of the skin. It happens when uh blood begins to pull in the lower capillaries. Um if you stay in that position for a period of time, what happens is is that area that's the lowest portion of your body, that blood begins to pull due to gravity um staining the skin. And it just kind of helps us understand if a body has been moved or repositioned.
And I couldn't find any evidence of that with Mrs. Flynn. >> So what can you tell us about the appropriateness of the liability regarding her position? >> It was appropriate for the position that we found her in. There was no indication that she had been moved or repositioned. >> What did you observe in regards to defensive wounds on action? I I didn't see um anything that I would consider like a a defensive wound, but um the examination of her body was very cursory.
Um and a lot of times we leave that to the forensic pathologist to make those determinations. Who did you contact after Ashley was secured in my deck? Um Dr. Gin and a transport company. And where was Ashley transported? I believe to the Montgomery County Corner's office. You may. >> Thank you. I'm not any previously marked for identification purposes. States exhibits 107 to 122. Do you recognize those? >> I do, sir.
What do you reckon to be? >> Uh, these are photographs of um the pillow that was located beneath uh Ashley Flynn as well as like areas of blood that were found in the master bedroom. >> Do they fairly inaccurately depict the scene as you observed it on February 16th? >> They do. >> Did you observe any transfer stains that would indicate that Ashley was moved after the bloodshed event? I I I didn't. Um but as we took off that white comforter, uh we created some transfer stains.
Where were those? Um those would have been like on the back side of Ashley Flynn on the um gray sheets um and closer towards the edge of the bed. Um and something that um as we were carefully kind of moving that comforter off, there was a part that was bloody in it. it made contact, but those were created by us. >> And when you reviewed the the blood stain pattern analysis, what supported your conclusion that the victim was not moved or repositioned? >> Um, primarily um when we looked at her face and we looked at the blood that was emanating from her nose and from her mouth, um they were moving with um gravity down towards the pillow.
Um, a lot of times what we see when we have someone who's repositioned, um, is that as that blood flows downward, um, and then they're moved, um, the blood can can kind of take a bend or or can go in a different direction. And we didn't see any of that with Mrs. States exhibit um, >> 107 >> 107. Uh, this is a photograph of the light switch. It's going to be on the west wall of the master bedroom. It's right beside the doorway going out into that hallway.
Um, and what you see is um a reddish stain on the white um light cover and it's been marked with um sticker A. And how would you describe that stain? >> Uh it's just a a red brown stain. It's um linear in shape. Um it looks like there's um a transfer stain. That's exhibit 108. What do we see here? >> Uh this is a photograph of that same stain. Um what um CST Resnick has done uh is to sample a little bit of that blood onto a sterile swab.
Um she's placed um some tetromethylenzadine on the stain and then an oxidizer which is hydrogen peroxide. Um in that case what we get is we get a color change which is green and that tells us that it's presumptive positive for blood style 109. >> Uh 109 is a photograph of the the gray pillowcase. Uh the gray pillow that's underneath of Ashley Flynn. You see there are some small stains. Um, this is going to be on the back side of her head.
Um, and when we see those types of stains, generally what we um are looking at is we're seeing like a static pool of blood that's been acted on by a force and then that static pool of blood is is broken up and deposited on the surface of the pillow. >> [clears throat] >> Just for the record, I confirm objection to publishing any of these photos. >> So duly noted. When I say these photos, I should say states exhibits 107 122 for the record. >> Let the record reflect that there's no objection to the publishing of states exhibits 107 through 22. 122. >> 110, please.
What do we see here? Uh, this is a photograph of the lamp. It's on the nightstand on the north side of the bed. Um, and what you're seeing here is a a sticker marked with the letter C, and that's just used to mark the location of several red brown stains that we suspected to be blood. Um, the surface of that lamp is facing towards Ashley Flynn's head. State exhibit 111. This is just a photograph, a close-up photograph of that same area on the lampshade.
This is exhibit 112. Uh 112 is um uh you'll see a sticker D on the um east wall of the bedroom. It's behind the nightstand and it's just pointing out another area of red brown stain that's suspected blood. space exhibit 113. This is just a closeup of that same area on the east wall. How would you describe blood stains C and D? >> Um they were um uh small um probably 1 to 2 millime in width. Uh the shape was a little bit irregular.
Um when we do bloodstain pattern analysis um the one thing that we want to do is we always want to work with like smooth surfaces in both of these cases the wall is textured and the lampshade itself is textured. So we documented the stains and their size but there's not a lot else that I can say other than they appear to be spatter exhibit 114. Um, these are additional stains, uh, suspected blood stains. These are on the north wall, um, of the bedroom and it's beside the doorway, uh, going into the bathroom.
Safety exhibit 115. Uh, these are close-ups of the two stains at E and F, just uh, showing the the shape and the size of the stains. And well, what can you say about ENF? >> Um, I can just really talk about the size of them. They're smaller. Uh, they appear to be like nearly symmetrical. Um, there are very few stains. So, we don't get into classifying the mechanism just because of the small volume of stains. You mentioned spatter.
What is blood spatter? Uh blood spatter is when you have um a pool of blood um and there's some type of a force that acts upon that blood and it disperses outward. Um there are a lot of different mechanisms that can create blood spatter. Um and um yeah, states exhibit 116. Um this is a photograph um of the pillow that was beneath Ashley Flynn's head. Um there are two um stickers that have been placed. Um both of them show an area of damage um in the um outer shell of the pillow.
It appears in this uh photograph that the gray pillowcase has been removed and what you're seeing is that outer shell of of the pillow itself. And how close are those two marks to one another? Oh, very close. >> 117. Uh, this is a photograph of that same pillow. If you can imagine that we've taken off the pillowcase, which was gray. We've [snorts] unzipped the outer shell of the pillow itself, which was white. And what we have now is what we call like the batting or the kind of the support portion of the pillow.
Um, we've put in two adhesive stickers on top of the batting just to kind of point out two areas of damage on the right side of that pillow batting um, in the area where the suspected blood was located. And what you observe by those stickers, >> um the very top um area of damage, we located um a fired bullet inside of the batting. Um it had um you know, blood and matter um adhered to the bullet itself. In the lower hole, uh, we found a portion of copper jacketing along with a fragment, um, a bone fragment, um, potentially from Ashley Flynn's head.
Um, when we explored the, um, the entire length of the damage in that lower hole, we found that um, a potentially a projectile had um, exited out of the batting. Uh we re-examined the um the gray pillow case on the underside in that area and we found a slit where a projectile had likely come out of the pillow. >> 119 >> 118 >> I'm sorry 18. >> What do we see here? Uh these are those areas of damage and what you're starting to see is that copper jacketing and you're starting to see the fired bullet 19. >> What do we see here? >> Again, just the same two areas of damage and you're starting to see that that um fire bullet as well as the jacketing.
Another closeup of that same area. 121. Um 121 is uh what we labeled 16.3. This is the fired bullet that came out of that pillow batting. Um and you'll notice that there's um suspected blood and matter as well as hair um kind of attached to the bullet itself. It's on the left side of the bullet there. What can we see >> on the left side of the bowl? >> Um, I'll show you 122 and I'll ask the question again. Can I ask 122?
Uh, this is um 122 is a portion of the copper jacketing or a piece of copper jacketing um from one of the bullets. >> And what else? And then a portion of the bone fragment as well as hair and matter. Where did you later learn another fire bullet was recovered? Um, we learned that, um, during the autopsy examination, there was a bullet recovered from, uh, what was described as the the left elbow area of Ashley Flynn?
Were you able to locate the uh, any firearms that would have fired that projectile in the residence? I did not. What would you need to do to the home to be sure that the firearm was not in it? Um we we can get pretty um invasive and destructive uh when we search for things. Um uh there are always a lot of u places where things can be hidden inside of a home. Um in one particular case that I was involved in um >> objections to other cases.
He was asked a simple question. What is he >> sustained? Thank you. Through your experience, Agent Hammond, where have you found things hidden in homes? Objection to the evidence. >> I'm going to allow it. Over the road. >> Um, we've located evidence um hidden in uh duck work um and appliances buried in the ground. Um [snorts] there are lots of places to hide things inside the home. >> What is gunshot residue? Uh gunshot residue um is the product of a weapon firing.
Um the bullet um exits the muzzle and brings with it um with burium and antimony with them. Unburnt powder. Um gunshot um residue or gunshot powder is that unburnt um portion of the propellant that gets deposited um onto the victim or to surfaces around a back gunshot. And when is it uh gunshot residue most probative in an investigation? >> Um typically um my understanding of gunshot residue as it as it pertains to um finding it on a suspect is generally within that first 2 hours. >> Wow.
Um it's uh gunshot residue can be very fragile. It is very fragile. Um it's um often like lost or displaced um with handashing. uh you know, you go to the restroom, you wash your hands, a lot of times that uh that gunshot residue is lost. Um you can lose it when you put your hands inside and out of a a pocket. It takes it away. Um so typically about 2 hours is the window that we typically try to get gunshot residue. >> How is gunshot res gunshot residue quantitative?
Um my understanding of the testing inside of the lab is that when we um when we take a stub um just imagine like a small little tube with a um adhesive circle at the end and you you dab it onto someone's hand. Uh typically the area where we collect gunshot residue is on this web of the hand in this area right here. And so we'll take that adhesive sticker like ampule or and we'll collect as much as we can um onto that sticky pad.
Um the laboratory what I've been told over the years is that they look for the presence of you know variant antimony lead. Um but once they find that then they stop. Um it's not like um like a DNA examination where they say um you know this completely matches what they say is that these elements are there and therefore it's a positive test but they can't say that there are 10 million parts there. It's just it's either there or it's not. >> How could someone placing a towel found on Ashley's head impact the body of a gunshot resident?
Um if if someone handled um Ashley Flynn after she was shot um or tried to place a a towel at the back of her head or manipulated the blankets uh potentially um through transference they could um have gunshot residue on their hand or the items that they moved around on that bed. What items did you collect from the area of the bed in the primary bedroom? >> Um, we collected um the comforter, uh the flat sheet, uh beneath her, the fitted sheet, uh the pillow, uh the fire bullet, uh the uh jacketing from the pillow.
We collected the cell phone, uh the water bottle beside the nightstand, uh her purse. Um, on the opposite side of the bed, I collected a um a digital like a health ring, like one of those um not sure what you call those anymore. Um, it's one of those rings that monitor your blood pressure and your activity level. Um, and on the south side of that bed, there was that in that nightstand, there was a smart watch or a digital watch with a broken band reflected that as well. >> What' you locate on the floor at the foot of the bed?
Uh, the two cartridge cases I'm now hearing you what's been privacy for identification purposes exhibit 262. You recognize that? >> So you recognize it today? >> Uh this is the um the first uh fire cartridge facing located in on the bedroom floor. uh had the head stamp of WCC3 and it was marked with placard one. >> Is that the package you placed the casing in? >> Yes. >> And what can you tell me about the condition now of that packaging compared to when you collected it? >> It looks like it's been opened and I see some like BCI uh labeling that's more laboratory generated.
Are the all seals on that item intact? Yes. Could you please open that for us? What do you have there? Uh, this is another Manila envelope um with additional markings and they appear to be like lab generated numbers and initials. The seals impact on that. >> Yes. What do you have there? Um, this is the uh WCC 03 fired cartridge casing that was collected from the bedroom at 9:30 Cunningham Court. >> And is that is that in the same condition it was when you collected it? >> Yes.
Yes, now was previously marked by education purposes exhibit 262. You recognize that? >> Yes. What do you recognize? >> Uh this is uh the fired cartridge casing. Uh it's uh it was the WCC3 and it was identified with placard number two uh collected from the bedroom floor at 9:32 coming in court. Is that the package you collected the item in? >> Yes. Mr. Watkins, what's the labeling of Stacy Zix? We just did 262. Is this 263? >> 263.
Yes, sir. >> Thank you. [clears throat] >> Is that the package you placed that um shell casing in? >> It is. And is it in the same condition it was when you placed it in there? >> Um it looks like it's been open for like laboratory examination. >> And are all the seals from it being opened intact? >> Yes. Would you please open that for us? And what was inside? >> Uh, just another manila envelope um with markings consistent with laboratory testing. >> And the seal intact on that? >> Yes.
What do you have there? Uh we have a fire cartridge casing with the head stamp of WCC3. Uh this was uh placard number two collected from uh the bedroom floor at 9:32 Cunningham Court. >> That's the item you collected by placard number two. >> Yes, sir. >> Was it in the same condition it was when you collected it? >> Yes, sir. You mentioned a purse that was inside the primary bedroom. Yes, sir. Where was it located? >> It was on the north side of the nightstand uh along that east wall north of Ashley Flynn. >> Did you Did you examine the purse? >> I did. >> What did you find?
The purse contained? >> Uh her driver's license. Uh some bank I'm sorry, whose driver's license? >> Uh Ashley Flynn's driver's license. Um some of her bank cards. Um some hairbrush. look at some some cosmetic type of uh items uh normal stuff that you would find inside of a purse. >> And you me mentioned some shotgun shells were found in the south nightstand or the nightstand that was furthest from Ashley. >> I did. >> What can you tell us about that ammunition? >> Uh they were 12 gauge uh shotgun shells.
Uh each of the boxes uh were full. It didn't look like any of the ammunition had been uh removed or fired. >> Were you able to locate any firearms in the residence that that ammunition was compatible with? >> Yes. >> Where was that located? >> Uh that would have been in a walk-in closet. >> Amen. What do you recognize them to be? >> Uh, these are photographs of the bathroom off of the master bedroom as well as the walk-in closet.

Uh, I don't believe so, sir. What information are you able to give to us in regards to the the rifle and the shotgun? >> Um the the shotgun was a Mossberg 12 gauge.
Um and then the the rifle itself was a Western field 22 rifle. Where's the kitchen area of the home located? >> Uh it would be in the um the central portion of the home. And could you describe the condition of that kitchen area? Uh the kitchen was very clean. Um the counters were very clean. Uh we did a little bit of an examination on the kitchen sink itself. Sir, I'm now handing you what's been marked for identification purposes.

Yes, sir. >> What do you recognize in the video? >> Uh, these are photographs of the remaining portions of the home that we haven't talked about. Um, including the kitchen, the living room, uh, a home office, a child's bedroom, a playroom, and then a bathroom. And do they all fairly and accurately depict the scene at 932 Cunning James Court when you were there on February 16th, 2026?

Um, and this is a photograph looking uh to the west uh from the area of the um a rear door that opens out into the patio. >> You previously mentioned that you did some examination on this sink. >> I did. Um what did you observe in the bottom of the metal sink? there were some um pinkish red stains uh both on like a washcloth and then kind of droplets uh on the on the the basin of the sink.
Um and during the scene examination, we tested those. Um again, we you know, we swab that area with a a sterile swab and we used a petrol benzadine or TMBB to test those areas for the presumptive source of blood and in both cases they were negative. exhibit 85. Uh this is another photograph of the kitchen area. It just shows the um location of a black Apple um smartwatch that was found on the counter. Stage exhibit 86.
Uh this is a close-up photograph of that same uh Apple smartwatch. Takes exhibit 87. This is another photograph of that same area just showing that we've identified it with placard 7. Um how is the bottom bunk configured for two people to sleep? >> Um I I don't I don't think it would be. Um it doesn't look like there's room for um anyone other than maybe a small child unless the unless all of the stuffed animals were removed. How many pillows were on the bottom bunks? >> Um I believe that there was one um maybe maybe two and then a high volume or something.
Stacy's at one. Uh this is a just another photograph of this um same bunk bed just showing kind of a different angle of the open space on that lower bunk 106. Um this is just a photograph of the upper bunk. What type of fan did you observe in the children's bedroom? Um, it was very similar to the one that was located in the master bedroom. It was a box style fan. Um, it was running at the time of the scene examination at the high speed.
Um, just like the [clears throat] fan in the master bedroom, it was positioned against the wall. >> What volume of noise was that fan producing? >> Um, a good a good amount of of noise. Uh one projectile fragment and jacketing located inside the pillow in the bed in the master bedroom.
Is that the packaging you collected the item in? >> It is. [snorts] And what's how's the condition of that packaging changed since you packaged it? >> Looks like it's been to the lab for testing. >> And are all the seals intact on the packaging? >> They are. Could you please open the door for us? What's inside? >> Uh, this is a clear plastic baggie and it's been marked with the laboratory's uh number and then marked with bullet jacket fragment.
And that bullet jacket fragment is that does that appear the same as when you collected it? Yes. >> The same as we saw in the photos just a little bit ago. >> It's other than being cleaned. >> Yes. Um there's a a second um packaging. This looks like it was created by the lab. It has their lab number and it has apparent bone uh fragments. Could you open that for us, please? >> Are those bone fragments in the same condition they were when you collected them? >> Um, they appear drier. um uh the the suspected blood is is not as prominent.
Um but yes, overall same condition. Thank you. How did you decide where to examine in the property of 932 in court for latent fingerprints? >> Um, we really um tried to follow um the scenario that was laid out um based on that there was forced entry on that north wall of the garage. uh moving past the refrigerator, um past the uh the Town Country minivan, um into the Ford F-150 [clears throat] truck, uh into the home through the garage door that accessed through the hallway [clears throat] between the the master bedroom and the laundry room and into the uh master bedroom.

So that was a location of where we found a latent print and we attached that adhesive sticker there so we could photograph it and label it for collection. 124, please. This is a close-up photograph of that same laten print.
It's on the uh the door casing in the master bedroom. Did you lift that printer? We did. How did you do that? >> Um we used just a some some tape um and we put it onto a clear sheet of plastic. uh that way that can be taken to the laboratory and examined by the uh the latent print examiners. 125 please. >> Uh this is a photograph. This is we're at the same door. We're just on the opposite side. Instead of looking out, we're looking into the master bedroom.
Um what you see on the left hand side of that door casing is um another adhesive sticker. This is LP2. And this is where we found another latent print. 126, please. This is a close-up photograph. This is the same area. That's just a laten print closeup. Were you able to lift that print? >> Yes, sir. >> How did you do that? >> Again, we uh just use um some some tape. Um we smooth it out. Uh carefully lift it from the surface. and put it onto a clear sheet of plastic. 127.
Uh, this is just a a little bit closer view of that same fingerprint. 128, please. This is a photograph. This is the interior side of the door leading from the hallway to the garage. And what you'll notice is another adhesive sticker on the interior side of the door a little bit above the the deadbolt throw. Um, and it's just showing us where lat print number three is at 129, please. >> Uh, this is a close-up print or a close-up photograph of latent print number three.
It's again, it's on the interior side of that door leading out to the garage. 130, please. Now, this is another closeup of this same uh baking print. Were you able to collect that print? >> Yes, sir. Uh, this is a photograph of the F-150 uh truck, the Ford truck in the garage. And what [snorts] you'll see is that we've used some white powder to examine the driver's side uh for latent prints. >> Why' you choose to examine the driver's side? >> Um, it was the closest to the garage door. We processed a pretty good deal of the truck itself. >> 137. >> Uh this is a a photograph of um latent print number six. This is where we located some uh latent prints on the exterior surface of the driver's side door. 138.
Uh, this is a close-up photograph of Lakeon print number six, 139. This is another uh photograph of that same print. Were you able to lift that print? >> I was. And you do the same or you had the others? >> Yes, sir. >> 140, please. Uh this is a photograph of um a pretty badly smudged uh fingerprint palm print. Uh would have been on the north side of the uh Chrysler minivan um along the hood area. >> What are the the spots along the side of the van there? >> Uh it looks like water marks things.
Are they more apparent from the powder? Uh they are um typically like um uh if a car has been like washed a lot of times and maybe it isn't dried um as thoroughly um sometimes we'll we'll see some water marks uh on the vehicle. >> 141, please. >> Uh this is a closeup of that that smudged area. Um, it looks like like there had been some kind of contact there at that at that hood, but there was no friction ridge detail. 142, please.
This is the um passenger side of the van. Um, and it just shows the area. What's the What do you have there? Uh these are the clear sheets of plastic that we um put the latent prints onto. Um, typically what we do is we try to u to mark and identify where each print was lifted from. And so which print do you have there in your writing? Um, I believe that this this print may have been lifted by Holly Resnik. She's put her initials um there on the side. Um, but you'll see that that adhesive sticker is um attached to the area of the print. How about here? >> Um this is um latent print um number two and three.
Uh this is that exterior door frame. The top one is from the exterior door frame of the master bedroom. And I've put my initials and the date down at the bottom. Um and then Lat print number three which is from the uh the door to the garage. Uh this is um lat print number four and five. This is from the door frame in the hall to the garage on that interior surface. Uh this is late in front number six. This is the Ford F-150 garage door.
Uh the driver's door exterior. Uh this is [clears throat] laton print number seven. This is that front passenger leg of a car. This is lat print number eight. This is from the side of the refrigerator of the north wall. And this is lat print number nine, also from the side of the refrigerator of the north wall of the garage. And are all of these latent prints in the same condition as they were when you submitted them to the lab? >> Yes, sir.
And that means for identification purposes states exhibit 266. Do you recognize that? Uh yes. >> What do you recognize it to be? >> Uh this is the smartwatch. Uh it was placard number seven. This was collected from the countertop in the kitchen. And is that uh what's inside the bag? Um you can see um there's a a black Apple smartwatch. And is that watch in the same condition as it was when you collected it? >> It appears to be.
Yes. >> Who did you and crime scene technician Isaac talk to about DNA in regards to the cartridge casings? >> Uh we talked to the um the DNA supervisor in the London office. >> When did you do that? >> Uh while we were at the scene. >> And after that conversation, what did you do? Uh she instructed us to use a sterile swab uh moistened with SEB or stain extraction buffer to collect um touch DNA or or DNA from both of the cartridge casings onto one swab and to package that swab as evidence so it can be analyzed for potential DNA. >> Who did you and crime scene technician Rise meet with after completing your examination? uh the detectives from Tip City, um some of the um the administration from from the Tip City Police Department.
There were um a few people, some of which I I I don't remember and I didn't recognize when I was there. >> What did you discuss during the meeting? >> Um we just discussed uh whether the investigation goals for day one had been um had been met. Um we encouraged um the detectives to maintain the scene uh until the autopsy was done and we felt like there was um there was more searches that needed to be done um particularly like in the mechanical room uh the area of the the tool bench or the workbench um that there needed to be um secondary searches of the home completed um after we left.
At the conclusion of your examination of the scene, what items did you retain? >> Um, I retained the um the strike plate from the um the dead bolt that was located between the wall and the trash can and the screws. Uh the doorork knob and the rose. Um I took with me um the um swabs that we used to collect potential uh DNA from the garage door into the home. both the exterior and the interior handle. I took the laten prints with me.
Um, and I'm trying to think what else I may have submitted to the lab that very first submission the next day. Where did you which lab did you submit on that to? >> Um, I transported those items on the 16th to the green office of BCI. Uh the evidence was taken and placed into a temporary locker um about 9:30 p.m. Um and then the following day I moved those items out of that temporary locker and submitted them to the laboratory. >> Approximately what time did you leave the scene? >> Um about 7:30 p.m.
How long were you there on scene? >> Um about 12 hours. And based upon your training education experience, what conclusions did you draw at the end of your scene investigation? Well, my concern at the end of uh the scene examination was that this was a homicide and it was staged as a burglary. [bell] Are all the photos you viewed today fair and accurate copies of photos you took on scene? They are. May I have a moment, Judge? >> You may.
Sir, I'm not showing you what been previously marked for identification purposes. Exhibit 155 to 166. You recognize those. >> What do you recognize them to be? Uh these are additional photographs of the garage door in the north wall of the garage and do they fairly inaccurately depict what you observed coming in court on February 16th you permission to publish your honor exhibit 155. Can you tell us what we see there? >> Uh this is a photograph of the exterior of the garage door.
Um, you'll just notice that there's some white uh fingerprint powder that's been added uh to the door itself. You'll notice that the door handle itself has been broken off on the side. >> How do you choose when you use white or black powder? It just has to contrast. If you have a dark surface, we use a light powder and vice versa. >> 156, please. >> What do we see here? Uh this is a close-up photograph of the door handle area.
Um and you'll notice that the handle itself has been broken off. Um what else? You'll also notice that um the frame itself uh beside the door handle and the dead bulb um is in very good condition. The weather stripping uh between the wood and the door itself is in very good condition. Did you locate any prints >> or footwear impressions or anything of that sort on the exterior of that door? >> I did not. >> 157, please. >> What is this photo show?
Uh, this is a close-up photograph of the receiver and the door frame. Uh, that north garage door. Um, there's been an adhesive sticker added just to show the size of the the tool marks in the wood there. 158. This is a closeup of that same area. Uh, the tool marks just it's uh on the interior side of the door in the area of that deadbolt receiver. 59, please. Uh this is a photograph. Um placard number 20 shows the um the deadbolt receiver that was badly bent.
It was located between the wall and the trash can. And then 21 shows the location of the handle and then the collar or the rose of the of the door handle. 260 please. Uh this is a photograph uh showing the location of the door handle and that collar on the interior side of the garage door. 161, please. This is a photograph of that damaged uh deadbolt receiver again between the wall and the trash can. 160, please. >> Uh, this is a closeup of that um receiver and then the two screws that were located on the concrete just outside the door 163.
Uh, this photograph depicts the door handle, the collar, and then you'll also see the wood fragments that were on inside of the garage door on the floor. 164. >> Uh, this is a a close-up photograph of the door handle and the rose or the collar, just showing the damage uh on both 165. Uh, this is a close-up photograph of the wood that was located on the garage floor in 166. Uh we are um starting commencing our afternoon session on the third day. Um we are in the midst of a special agent Hammond's uh testimony and we're going to begin cross-examination before we bring in the jury council.
Is there anything that we need to address? >> Mr. Mosor, please bring in the jury. Special Agent Hammond will remind you you're still under Ladies and gentlemen, Joy, please have a seat. Welcome back from your lunch break. I remind you to turn off your phones and those in the gallery the same. Uh we are going to begin with the cross- examination of special agent Hammond by uh defense council Mr. Mulligan. >> Yes. Thank you, Judge.
Hannah. So bottom line, when you come on the scene in a situation like this, when you're called as the secondary agency or called in to assist, you're coming on the scene after the event. Correct. >> Correct. >> And basically, you're working backwards. Correct. >> Um, can you maybe explain that a little bit more? Well, you didn't witness the event. So, by definition, you're starting at somewhat of a disadvantage. You're working backwards and trying to find a solution.
Correct. >> I think that's correct. I didn't I didn't I witnessed the answer. >> And on some of the preliminary questions um this morning, you indicated that the PCI was particularly competent when doing a blood splatter uh pattern analysis. Correct. >> Can you ask that one more time, please? >> Sure. On some of the preliminary questions this morning, you indicated that BCI was good at doing blood spat splatter pattern analysis.
Correct. >> Um the crime scene unit is is uh particularly trained to look at um uh blood spatter patterns uh when the conditions are right to do so. >> Okay. And that was not done in this particular case. Correct. >> Uh because of the conditions. >> Okay. And one of the advantages sometimes in blood splatter analysis is to determine who in fact was on the scene at the time. Correct. >> Uh that would be something that we would look at as far as like a reconstruction.
Yes. >> Sure. If you're close enough as the perpetrator to the actual scene, you can end up with blood splatter on you in the right situation. Correct. >> Correct. >> Did you order the seizure of what Mr. Flynn was wearing on that particular morning? >> Um, and discussions with the detectives, some of the conversations were to to retrieve his clothing from him. >> And nothing was found on that clothing, was it? Um 3 days after the initial scene um I went to the London office of BCI uh where the NA um scientist looked at clothing.
Uh there was some blood found on one particular item but it wasn't sufficient enough for us to do anything as far as a blood spatter reconstruction. Bottom line, there was no match >> match to his DNA or to >> Well, of course, there would be a match to his DNA of what he had on his person, but I'm talking about a match of blood splatter from Ashley onto his clothing from that particular incident. There's no way to say that. >> I'm not aware of that evidence existing. >> Thank you.
So, also in preliminary uh discussions this morning, hours ago, you indicated that you came upon the scene and that your arrival time was 7:09 a.m. Correct. >> Correct. >> Okay. And that was a long time after the 911 call. Correct. Several hours. But certainly if the 911 call was around 2:30, we're talking a bunch of hours. Correct. >> Um, just doing the math, three, four and a half. >> Thank you. And um, as far as when you got on the scene, you were quote unquote given a briefing and that briefing came from the police.
Correct. >> Correct. And we know from that briefing that no one saw the intruder in this particular case. Correct. >> Um the briefing didn't indicate that anyone was identified as entering the house >> and no one saw the door that the person entered. I think the briefing indicated that the uh perpetrator or the the person entered through the garage was the information I was provided. >> Sure. And that information came from a nonlaw enforcement trained individual who was under great distress at the time.
Um I was provided that information from the T city police department. The only person that they got that information was from Mr. Flynn. >> Okay. And the jury got to see what state he was in when that information was being provided. Objection. Is there a question? >> Yes. Um, sustained. >> Bottom line, you accepted the briefing without interviewing Mr. Flynn. Correct? My role at the scene was to >> Is that a yes or a no? >> Can you ask the question again? >> Sure.
You did not interview Mr. Flynn. >> That's correct. >> So, you accepted the wording and the briefing without interviewing the source of the information on that particular jacket. Correct. >> My role as >> I don't care about your role. That would be a correct statement. That's a yes or no question. >> That's correct that I did. >> Thank you. As far as your decision or um conclusion that there was no forced entry on the rear door, you found that door to be unlocked.
Correct. >> I did. >> And you don't know how many days that door was unlocked. Correct. >> That's correct. And when you got your briefing, you were told there was a refrigerator that sat in front of that door. >> Yes. >> Implying that the door was never used. >> Yes. I'm not sure. >> Okay. As far as the damage on the outside of the door, the door handle and what have you, the what you call I think the rose. Um that damage cannot be determined when that occurred. >> I can't as far as a time.
No. >> So we don't know how many times the person who did that came to that particular property to do that. Correct. >> I I can't provide that answer. >> And there's no test that you're aware of that would determine whether or not that door was eventually um picked. In other words, the lock was picked. You have no idea. >> I I don't >> I don't think there is a test to that, is there? >> I don't believe so. You indicated that there were some items and I believe that there was a photograph of some items in the freezer of the refrigerator. >> Yes. >> And the only thing that was in the bottom of the refrigerator was a little box of baking soda. >> Yes. >> Okay.
Did you weigh the refrigerator? >> I did not. >> Did you try and move the refrigerator? >> Um, I did not. Did you measure how much force would be used on that door to move that refrigerator? >> I did not. You would agree with me that there would be no way to determine the last time that door, that garage door, [snorts] I'll call it the side entry door was open before 216 of 2026. I don't know that answer. There's no way that I could determine that.
Now, you indicated at one point in your testimony that you gave tips the tip city police department the job of in investigating the workbench. >> I did. >> Why? um the amount of work that we were providing uh in other areas of the house. At times um when there's uh an area that needs to be searched, [clears throat] there's a lot of work that's involved. Uh sometimes we have to farm that work out um to the other investigators who are very competent to do those things. >> Okay.
Do you had you ever worked on a burglary case in Tip City before? >> I can't recall any. >> Okay. Did you ever work a homicide in Tip City before? >> I don't remember any. >> How do you know what their competence is
